Alani Nutrition, LLC, its parent, affiliates, and subsidiaries (“Alani Nu,” the “Company,” “we,” “us,” “our”) is providing this Privacy Notice (the “Notice”) to further the relationship between us and our customers. This Notice makes disclosures concerning our collection of personal information, purposes of collection, sources of collection, and measures we use to protect your information. In this Notice, personal information means information that (either in isolation or in combination with other information) enables you to be directly or indirectly identified (“personal information”). This Notice does not impose any limits on the collection, use or disclosure of business contact information or certain publicly- available information.

Information you provide directly to us. For certain activities, such as when you register, subscribe to our services, download our prepared materials, participate in or attend our events, participate in promotions and contests, interact with us on our websites, social media or otherwise, represent a business partner or supplier (including when acting as an ambassador) of Alani Nu, or contact us directly, we may collect some or all of the following types of personal information:
Information we collect from other sources. We may collect certain personal information from third-party sources (e.g., third party databases; current or former ambassadors' social media pages), to the extent permitted by and in accordance with applicable laws and, where necessary with your consent:
Information we collect automatically. To the extent permitted by applicable laws and, where necessary, with your consent, we may collect certain personal information automatically when you use our website, interact with our emails, or visit our social media sites (e.g., Facebook, Instagram, LinkedIn). We collect and use your personal information for one or more of the following purposes:
We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing notice to you and, if required by law, obtaining your consent. You have a choice. You may at any time request that we discontinue sending you communications, emails, or other correspondence.
We will not share personal information we collect from you with any third party, except as indicated in this Notice or as permitted or required by law.
Important Exceptions
We may disclose your personal information to a third party without your consent if permitted or required by applicable law. We may also disclose your personal information, in accordance with applicable law, in connection with a contemplated or actual reorganization, merger, acquisition, sale, joint venture, assignment or other disposition of all or any portion of our business, assets, or shares, provided that the disclosed information continues to be used solely for the purposes permitted by this Notice by the entity acquiring the information.
Affiliates
We may share personal information with our corporate affiliates and subsidiaries for the purposes described in this Notice.
Service Providers
We may retain agents, subcontractors or service providers (such as IT and website hosting providers, payment processors, marketing and marketing research providers, customer support, data storage, data analytics providers, auditors, consultants and legal counsel) from time to time in relation to our business or the products or services that we provide. If we require a service provider to deal with your personal information, we will take reasonable steps to ensure that the service provider adheres to privacy procedures and will keep your personal information confidential. We will not provide more information than is necessary to the service provider and will ensure that the information is returned or destroyed once the purpose for which it was given is filled.
Third Party Marketing and Analytics Providers
We may disclose personal information, such as device and browsing, and activities and usage information, to third-party marketing and data analytics providers, and other companies who provide marketing, advertising, campaign management, or analytics services on our behalf.
The Company is part of an international business, with operations, entities, and service providers in Canada, the United States, Sweden, and other jurisdictions.
You therefore acknowledge that personal information may be transferred to, processed and stored in foreign jurisdictions, and that the governments, courts, or law enforcement or regulatory agencies in those jurisdictions may be able to access or obtain disclosure of your personal information under a lawful order or otherwise through the laws of the foreign jurisdiction, regardless of the safeguards we have put in place for the protection of your personal information, and in these cases we will comply with applicable local laws relating to the disclosure or release of personal information.
We seek to protect personal information in our custody or control using reasonable technical and organizational measures based on the type of personal information and applicable processing activity and designed to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks. We are committed to minimizing personal information collection to the information that is necessary for some defined purpose. We will take reasonable measures, through contractual or other reasonable means, to ensure that the suppliers and agents who assist in providing services apply a comparable level of protection.
However, no method of transmission over the Internet, or method of electronic storage, is completely secure. Despite our safeguards and protocols, therefore, we cannot fully guarantee the security of your personal information and you should always exercise caution when disclosing personal information over the Internet.
We will obtain your consent to collect, use, or disclose personal information except where we are authorized or required by law to do so without consent. Your consent can be express, implied or given through an authorized representative. Consent may be provided orally, in writing, electronically, through inaction (such as when you do not notify us that you do not wish your personal information collected/used/disclosed for various purposes after you have received notice of those purposes) or otherwise.
You are not obliged to consent to the collection, use, or disclosure of your personal information, however please note that if you do not provide your consent, we may be unable to provide certain goods or services, or process an application or request, or manage our relationship with you.
You have the right to withdraw your consent to further use, communication, or processing of your Personal Information, as further explained below in the “Access, Rectification and Other Rights” section of this Notice.
We may use technologies on our website and in our emails that are intended to facilitate the use of the website and make it more user-friendly and to provide various functionalities and to help deliver cookies, count visits, understand usage and campaign effectiveness and determine if an email has been opened and acted upon. Such technologies include, for example, cookies, pixels, tags, local storage objects, APIs, web beacons, scripts, and other mechanisms to automatically collect browsing, activity, device, and similar information within our services and to target advertising and content. Such technologies may include, from time to time, any of the following:
Cookies. Cookies are alphanumeric identifiers that we transfer to your device’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our services, while others are used to enable a faster log-in process, support the security and performance of the services, or allow us to track activity and usage data within service.
Pixel tags. Pixel tags (sometime called web beacons or clear GIFs) are tiny graphics with a unique identifier, similar in function to cookies. While cookies are stored locally on your device, pixel tags are embedded invisibly within web pages and online content, including Connected TV (“CTV”) streaming services. We may use these, in connection with our Services to, among other things, track the activities of users, help us manage content, and compile usage statistics such as click and media impression traffic. We may also use these in HTML e-mails we send, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.
Local storage objects. Local storage is a web storage mechanism that allows us to store data on a browser that persists even after the browser window is closed. Local storage may be used by our web servers to cache certain information in order enable faster loading of pages and content when you return to our websites. You can clear data stored in local storage through your browser. Please consult your browser help menu for more information.
Third-Party Analytics and Tools. We may use third party tools, such as Google Analytics, which are operated by third party companies. These third-party analytics companies may collect usage data (using cookies, pixels and similar tools) about our services in order to provide us with reports and metrics that help us to evaluate usage of our services and improve performance and user experiences. You can download the Google Analytics Opt-out Browser Add-on to prevent your information from being used by Google Analytics at https://tools.google.com/dlpage/gaoptout.
Cross-device Tracking. We and our third-party providers may use the information that we collect about you within our Services and on other third-party sites and services to help us and these third parties to identify other devices that you use (e.g., a mobile phone, tablet, other computer, CTV streaming services, etc.).
Third-Party Advertising. We may work with third parties, such as ad networks, channel partners, mobile ad networks, analytics and measurement services and others (“third-party ad companies”) to personalize content and display advertising within our Services, as well as to manage our advertising on third-party sites, mobile apps and online services including CTV streaming services. We may share certain information with these third-party ad companies, and we and them may use cookies, pixels, tags, and other tools to collect usage and browsing information within our Services, as well as on third-party sites, apps, and services, such as IP address, location information, device ID, cookie and advertising IDs, Internet service providers, and other identifiers, as well as browsing information. We and these third-party ad companies use this information to provide you more relevant ads and content within our Services and on third-party sites and apps, and to evaluate the success of such ads and content. If you would like to control cookie-based tracking for advertising purposes, to limit how apps track activity for advertising purposes, you can configure your mobile device privacy or advertising settings via “limit ad tracking” (iOS) or “opt out of target ads” (Android). You can also opt out of interest-based ads served by participating companies by downloading the AppChoices app available at https://youradchoices.com/appchoices.
Custom Lists and Matching. We may share or make available certain customer list information (such as your name, email address and other contact information) with third parties (i) so that we can better target ads and content to you across third party sites, platforms and services, and (ii) in some cases, these third parties may help us to enhance our customer lists with additional demographic or other information, so we can better target our advertising and marketing campaigns.

Our services/products are not intended for children and you must be the age of majority in your jurisdiction of residence to have permission to use our services and/or access our website/application. We do not knowingly collect, use, or disclose personal information from children. If you believe that we have collected, used, or disclosed the personal information of a child, please contact us using the contact information provided in this Notice, so that we can take appropriate action.
Automated Decision Making (ADM) refers to information processing, including personal information processing, which is done autonomously and exclusively without human intervention and results in a decision. ADM tools are employed to aid or completely replace humans in the decision-making process. If we render a decision affecting you based exclusively on ADM, we will inform you accordingly, no later than at the time the decision is rendered. Please note that you have a right to request access to the personal information used to make automated decisions about you and of the reasons and parameters that led to the decision. You also have a right to request that we correct information that we used to make automated decisions about you. You may also request the opportunity to submit observations to a person who is in a position to review the decision. You can exercise these rights by sending an e-mail to Privacy@Celsius.com.
We will only retain and hold your personal information for the duration reasonably necessary to fulfil the purposes listed in this Notice and to comply with applicable laws. As a general rule, we will delete (or, to the extent permitted by applicable laws, anonymize) your personal information no later than seven years after your last interaction with us, unless otherwise required by applicable laws.
Notwithstanding the above, we will retain any personal information used to render a decision concerning you for a period of at least one year after such decision was rendered.
All personal information we hold will be securely destroyed or anonymized in accordance with applicable legal requirements once the retention period set out above expires.
Access. You have the right to request access to the personal information that we are processing about you. Upon written request, we will provide you your personal information under our control. We will also give you information about the ways in which that information is being used and a description of the individuals and organizations to whom that information has been disclosed. We may charge you a reasonable fee for doing so. We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another security measure to ensure that personal information is not disclosed to any person who has no right to receive it. In some situations, we may not be able to provide access to certain personal information. If we refuse an access request, we will notify you in writing, document the reasons for refusal, and outline further steps that are available to you.
Rectification. You have the right to request the correction of any mistake in the personal information, whether incomplete or inaccurate, that we have about you. If a challenge regarding the accuracy of personal information is not resolved to your satisfaction, we will annotate the personal information under our control with a note that the correction was requested but not made.
Withdrawal of consent. You may withdraw your consent to the use and disclosure of your personal information, or opt-out of certain uses and disclosures, subject to any legal restrictions and upon reasonable notice to us. If you notify us that you withdraw consent, we will inform you of the likely consequences of that withdrawal, which may include our inability to provide certain services for which that information is necessary. This will however not affect the lawfulness of any processing of your personal information prior to the time you withdraw your consent, nor does this create an obligation for us to delete your personal information if we are otherwise allowed to retain it under applicable laws.
Lodge a complaint. You have the right to lodge a complaint regarding our handling of your personal information with us, or with the Office of the Privacy Commissioner of Canada or, if you reside in British Columbia, Alberta, or Quebec, with the provincial privacy commissioner in your province of residence.
If you are a resident of the province of Québec, the following rights are also available to you, in addition to those listed above:
Portability: You can ask for a copy of your personal information in a structured, commonly used technological format. You can also request that we transmit the data to another third party you designate, where technically feasible.
De-indexation: You have the right to request, in certain circumstances, that we cease disseminating your personal information or to de-index any hyperlink that allows access to that personal information by technological means, if such dissemination contravenes applicable law.

We will respond to your request within 30 days of receipt. To the extent permitted by applicable privacy laws, if further time is required, we will inform you of this and the reason for the delay, and the timeframe for response.

This Notice is effective as of the Effective date above. We reserve the right to change this Notice at any time. We will take reasonable steps to advise you of any changes to this Notice, including by posting the revised Notice on our website. We recommend that you review this Notice from time to time to obtain the current version. If a change to this Notice would result in collection, use, communication, or processing of your personal information in a new manner which differs significantly from that stated initially, we will, where required by applicable law, ask you to confirm your consent to this new processing of your personal information.
